Application filed seeking leave to institute the suit under 12 of the Letters Patent.

2.The suit had been filed seeking a Judgment and Decree in favour of the plaintiff as against the defendant to declare the plaintiff's title over the shares of the defendant company as per the judgment dated 27.02.2020 passed by the United States District Court for the Court of New Jersey and also for a mandatory injuction directing the defendant to include the names of the plaintiffs in its Register of Members.

3.The learned counsel for the plaintiff stated that the cause of action for the suit arose within the jurisdiction of this Court, where the defendant's office is situated and where the loan agreements, demand promissory notes and stock pledge agreements were entered between the plaintiffs and M/s.Wayne Burt Pte Ltd. 4.The plaintiff had instituted a suit claiming rights over the shares of the defendant company before the United States District Court for the Court of New Jersey and had also obtained a decree against the defendant herein. https://www.mhc.tn.gov.in/judis/

Pam 5.Since the United States is not a reciprocating country, the suit had been now instituted for the cause of action arose within the jurisdiction of this Court. 6.Leave is sought. Leave is granted.
