Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of mandamus directing the respondent to implement the order passed by the Tax Appellate Committee dated 26.03.2004 in the petitioner's property tax assessments which is clearly mentioned in the petitioner representation dated 29.12.2014.

ORDER

The petitioner has come forward with the aforesaid prayer.

2. The case of the petitioner is that he is the owner of the said property and made application for assessment. The respondent made new assessment and asked the petitioner to pay a very huge amount as property tax. Against which the petitioner revision which was disposed on 20.10.2003. Aggrieved against the said order, the petitioner preferred an appeal before the Tax Appellate Committee. While so, the respondent sent a demand notice on 11.10.2010 asking the petitioner to pay the dues from 2001-2002 onwards.

Petitioner made several representations to the respondent to effect the payment of property as per the Appellate Committe order. Till date there is no reply from the respondent hence the petitioner is before this court by way of this writ petition.

3. The short point raised in this petition is that the respondents are not obeying the order of the Tax Appellate Tribunal.

4. Considering the limited scope of prayer the respondent is directed to comply the orders passed by the Tax Appellate Tribunal dated 17.02.2004. If the petitioner had paid any excess amount it shall be adjusted towards the future years tax payment.

5. The decision taken by the Authority shall be informed to the petitioner in writing within 60 days from the date of receipt of a copy of this order. Writ petition is disposed of in the above terms.
