Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, against the second and fourth respondents to disburse the remaining amount of Rs.2,17,476/- (Rupees Two Lakh Seventeen Thousand Four Hundred and Seventy Six only) the medical claim within a reasonable time stipulated by this Court. The Writ Petition has been filed for directing the second and fourth respondents to disburse the remaining amount of Rs.2,17,476/- as medical reimbursement.
2. The petitioner had worked as Assistant Head Master and retired from service on 28.02.2009. He is drawing a monthly pension of Rs.40,208/- in which, a sum of Rs.497/- was deducted from the monthly pension for New Health Insurance Scheme established by the first respondent for the purpose of New Health Scheme, 2022. It is applicable to 2/5
the pensioner and his dependants. Under the said scheme, the petitioner is entitled for a sum of Rs.4,00,000/- for medical treatment for a period of four years. Thereafter, the said scheme was also extended from time to time.
3. While that being so, the petitioner's wife undergone treatment for kidney problem in Dr.Kamashi Memorial Hosptial, Pallikaranai, Chennai. The total medical bill is Rs.3,94,176/-. After submission of original documents along with original bills furnished by the hospital to the fourth respondent, the third respondent disbursed only a sum of Rs.81,500/- to the petitioner. Therefore, the petitioner preferred an appeal before the third respondent and the same was not considered by the third respondent.
4. In view of the above, the second and fourth respondents are directed to consider the claim of the petitioner and disburse the balance medical bills amount of Rs.2,17,476/- on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. 3/5
5. With the above directions, this Writ Petition is disposed of. No costs.
