Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the second respondent to dispose of petitioner's representation dated 26.03.2024 for cancellation of patta in the name of the fourth respondents For Petitioner : Mr.M.Ravi For Respondents : Mr.P.Sathish for R1 to R3 Additional Government Pleader 1/5
O R D E R
The petitioner herein seeks a direction to the second respondent to consider her representation dated 26.03.2024 for cancellation of patta in the name of the fourth respondent.
2. According to the petitioner, she purchased 1.87 acre of land in S.No.74/5A at Yekkur Pudhur Village, Uthangarai Taluk, Krishnagiri District. The property purchased by the petitioner was later sub-divided as 74/5A. The fourth respondent herein purchased 97 cents in S.No.74/5 and the same was later sub-divided as S.No.74/5B. Though the petitioner is entitled to 1.87 acre as per the registered document in her favour, in the revenue records the extent for S.No.74/5A was wrongly mentioned as 1.84 acre. However, in respect of the fourth respondent in S.No.74/5B it was wrongly mentioned as 1.03 acre instead of 0.97 acre. Hence, the petitioner submitted a representation on 26.03.2024 to the second respondent seeking rectification of the entry in the revenue records with regard to the extent, but the same has not been considered. Aggrieved by the same, the petitioner is before this Court. 2/5
3. Mr.P.Sathish, learned Additional Government Pleader, who takes notice for the respondents 1 to 3 would submit that the representation of the petitioner will be considered, on its own merits, within a time frame fixed by this Court.
4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the second respondent to consider the representation of the petitioner and pass final orders, on its own merits, within a period of 8 weeks from the date of receipt of a copy of this order and after issuing necessary notice to the fourth respondent.
5. With the above direction, this Writ Petition is disposed of. No costs.
