Respondents Prayer: Petition filed under Article 226 of the Constitution of India

seeking issuance of a writ of Mandamus directing the respondents 1 to 5 to dispose of the petitioner's representation dated 26.02.2024 for removal of encroachment made by the sixth respondent. ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) The writ petition has been filed seeking a direction to the respondents 1 to 5 to remove the encroachment made by the sixth respondent based on the representation of the petitioner dated 26.02.2024.

2. Learned Government Advocate, on instructions from the fourth respondent, submits that survey will be conducted in the land in question on 13.08.2024 and based on the enquiry report, further action will be taken thereafter.

3. In view of the above, the writ petition is disposed of,

directing the fourth respondent to conduct survey of the land in question and based on the survey report, to remove the encroachment, if any, by following due process of law, preferably within a period of twelve weeks from the date of receipt of a copy of this order.
