ORDER

Petition seeking bail in connection with Crime No.104 of 2026 registered for the offences punishable under Section 103 of BNS, 2023, is on board for consideration.

The case of the prosecution is that due to sudden provocation, the petitioner and co-accused allegedly assaulted Rajesh near a coffee shop by

pushing him down, kicking him and attacking him with a stone, causing injuries that led to his death. Hence the case.

Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. He also submitted that the petitioner is suffering incarceration from 31.03.2026 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for the grant of bail to the petitioner. 4.

Learned Government Advocate (Criminal Side) appearing for the respondent reiterated the prosecution case and opposed for the grant of bail. He further submitted that the investigation is still pending. 5.

Heard both sides and perused the materials available on record. 6.

Taking note of the facts and circumstances of the case, nature of allegations, submissions made by the learned counsel on either side and considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
