O R D E R

The petitioner in this writ petition has challenged the award dated 15.02.2001 in I.D.No.118 of 1994 passed by the Labour Court, by which his claims against his employer have been rejected. The employer, who has been shown as the second and third respondents in the writ petition, has not been served with notice till date, despite the earlier orders passed by this court including that dated 17.04.2007. The private notice served to the second and third respondents by the petitioners have been returned with the postal endorsement as 'left'. In such circumstances, no useful purpose would be served by keeping the https://hcservices.ecourts.gov.in/hcservices/

writ petition pending without serving notice on the second and third respondents, who are the necessary parties for an effectual adjudication of the matter.

2.In the aforesaid circumstances, the writ petition is dismissed with an observation that if the petitioner is able to ascertain the whereabouts and serve the second and third respondents it would be open to the petitioner to apply for reviving of the writ petition in accordance with law.
