Respondents Prayer: Petition filed under Article 226 of the Constitution of India, seeking a writ of mandamus, directing the respondents to enroll the petitioner, as an advocate, in the Bar Council of Tamil Nadu and Pondicherry, in the forthcoming enrollment, subject to satisfying other requirements, under the Act and Rules made thereunder.

ORDER

(Delivered by the Hon'ble Mr. Justice S.M.SUBRAMANIAM) The writ on hand has been instituted to direct the respondents to enroll the petitioner as an Advocate in the Bar Council of Tamil Nadu and Puducherry.

2. Mr.M.R.Jothimanian, learned counsel appearing on behalf of the Bar Council of Tamil Nadu and Puducherry would submit that the application submitted by the petitioner was scrutinized. The Bar Council found that a criminal case has been registered against the petitioner in Crime No.39 of 2007 on the file of the Central Crime Branch, Coimbatore, for the offence committed under Sections 120 B, 468, 471 and 420 r/w 109 of the Indian Penal Code, 1860.

3. Since the criminal case registered against the petitioner is pending, his application seeking enrollment was not considered. Thus, we do not find any infirmity and consequently, the writ petition stands dismissed. There shall be no order as to costs. (S.M.S., J.) (C.K., J.) 09.07.2024 Index : Yes/No drm To:
