Respondents Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a ** Writ of Mandamus, directing the first respondent herein to consider and pass orders on the petitioner's application dated 09.07.2009 and reminder dated 31.10.2013, for issue of patta in respect of 1.51 acres in Survey No.393/1, situated at Avalapalli Village, Hosur Taluk, Krishnagiri District based on the report of the second respondent dated 27.01.2012 issued in Pa.Mu.3686/2010 (B3) within the time to be stipulated by this Court.

ORDER

Heard Mr.R.Bharath Kumar, learned counsel for the petitioner, M/s.P.Rajalakshmi, learned Government Advocate appearing for respondents 1 to 3 and Mr.K.Chandrasekaran, learned counsel appearing for respondents 4 and 5.

2. The petitioner seeks for a direction upon the first respondent to consider and pass orders on his representation dated 04.01.2010 for issuance of patta in respect of 0.10.5 ares in Survey No.411/1 situate at Avalapalli Village, Hosur Taluk, Krishnagiri District based on the report of second respondent dated 27.01.2012 issued in Pa.Mu.3686/2010(B3).

3. According to the petitioner, his request for grant of patta is now pending before the first respondent, who is the Appellate Authority. It is further submitted that the present patta is sought for pursuant to the correction effected while updation of the revenue records. It is submitted that the fourth and fifth respondents have also filed their objections and it is stated that the authority has also conducted an enquiry. However, till date no orders have been passed. Hence the petitioner is before this Court.

4. In view of the submission made by the petitioner there shall be a direction to the first respondent to consider the representation submitted by the petitioner dated 04.01.2010 and pass appropriate orders on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order, after taking into consideration the objections raised by respondents 4 and 5 and affording a fresh opportunity of personal hearing to the petitioner and respondents 4 and 5.

5. With the above direction, this writ petition is disposed of. No costs.
