Petition filed under section 226 of the Constitution of India to issue a Writ of Mandamus directing the 3rd respondent to consider the petitioner's representation dated 28.02.2015 and to give permission and protection for the procession / rally which has to be held on 08.03.2015.

Heard Mr.K.Gandhi Kumar, learned counsel appearing for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader appearing for the respondents. With the consent of both sides, this writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the 3rd respondent to consider the petitioner's representation dated 28.02.2015 and to give permission and protection for the procession / rally which has to be held on
08.03.2015.
3.The petitioner is a State President of Tamil Nadu Elementary School Teachers Association and they submitted representation to the respondent seeking permission to conduct rally and a meeting to voice the grievances of the Elementary School Teachers in the State. 4.The learned counsel for the petitioner submitted that the respondent police has granter permission for conducting rallies for various political parties, whereas, the petitioner represents association of Elementary School Teachers and they want to peacefully voice the grievances of the Teachers.
5.The learned Additional Government Pleader on instructions from the respondents submitted that the respondents are willing to grant permission for the meeting to be convened by them, but, however for the procession which they have proposed to take, since the route proposed by the petitioner is highly congested and there are other problems in the area, permission cannot be granted. 6.In the light of the fact that the respondents are willing to grant permission for the meeting, there will be a direction to the petitioner to submit another representation choosing an alternate route for the procession. It is open to the petitioner to offer more than one route which shall be considered by the respondents expeditiously, preferably before 07.03.2015.
7.This writ petition is disposed of with the above observation. No costs.
