The present Miscellaneous petition has been filed seeking to condone the delay of 40 days which was incurred in filing the Criminal appeal to set aside the order dated 30.01.2023 passed by the Hon'ble Metropolitan Magistrate, Fast Track Court III at Saidapet, Chennai in C.C.No.2171 of 2016 on his file.

2. Mr.K.Mohanraj, learned counsel appearing for the respondent vehemently opposed for allowing this petition.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and post the main case for admission.
