Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents to consider the representation of the petitioner dated 28.01.2019 in accordance with law by providing parking space to Tourists vehicle parked, parking at Mamallapuram, by the 2nd respondent and further, all basic amenities to tourists who are visiting Mamallapuram to secure the ends of justice. ORDER
[Order of the Court was made by M.SATHYANARAYANAN, J.,] (1)By consent, the writ petition is taken up for final disposal. Mr.B.Anand, learned Government Advocate accepts notice on behalf of the respondents 1 and 2.
(2)The petitioner claims to be a Member of Viduthalai Siruthaigal Party [VCK] and also claims that he is the Special Security Force of the President of the said Party. The petitioner has submitted representations dated 28.01.2019 and 26.02.2019 respectively to the 1st respondent pointing out that despite the fact that the Entry Fee/Toll has been collected whenever the vehicles enter the famous tourist centre of Mahabalipuram, there is absolutely lack of civic amenities and facilities and though the said representations were received and acknowledged, no response at all is forthcoming from the respondents and therefore, the petitioner came forward to file the present writ petition styled as a Public Interest Litigation.
(3)Heard the submissions of the learned counsel for the petitioner and Mr.B.Anand, learned Government Advocate appearing for the respondents 1 and 2, on instructions would submit that the representations submitted by the petitioner would be considered and disposed of at an early date. It is also the submission of the learned Standing counsel that for collecting Entry Fee/Toll in respect of the vehicles entering Mahabalipuram, the said license is auctioned and appropriate steps would be taken to improve the existing civic amenities and facilities.
(4)This Court has considered the rival submissions and also perused the materials placed before it.
(5)Though the petitioner has prayed for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner, either in his representations or in this writ petitions, directs the respondents 1 and 2 to consider and dispose of the petitioner's representation dated 26.02.2019 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
