A.No.2945 of 2024 in C.S.No.653 of 2013 P.VELMURUGAN , J., This application has been filed by the applicants/plaintiffs seeking permission to file additional documents in the suit in C.S.No.653 of 2013.

2. It is seen from the schedule of additional documents listed by the applicants/plaintiffs that the documents are existing from the year 2007 to 2022. Further, the applicants/plaintiffs have not stated any reason as to why they did not produce these documents earlier. The present suit was filed in the year 2013, before the enactment of the Commercial Court.

3. Before enactment of Commercial Court, amended Civil Procedure Code., Original Side Rules clearly says that all the documents have to be annexed with the plaint. In case, if the parties are not annexed the documents at the time of filing the suit, they have to produce the same before settling the issues.

4. In this case, pleadings have already been completed and issues were also framed. The case is now posted for filing of case management schedule. At this stage, the present application has been filed, however, the applicants have 1/3

not stated any reason for filing the additional documents belatedly at this stage. This Court is not satisfied with reasons stated in the accompanying affidavit filed in support of the application. Hence the application is dismissed. 24.06.2024 ( 2/ 2 ) mfa 2/3
