This is the Second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 27.04.2022 for the offences punishable under Sections 366 of IPC @ 366, 342 of IPC and Section 5(l) r/w 6 of POCSO Act 2012 in Crime No.90 of 2022 on the file of the respondent police.
2. The case of the prosecution is that the petitioner kidnapped the victim girl and committed the offence of sexual penetration many times against the willingness of the victim. Hence the complaint.
3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.16167 of 2022, on 13.07.2022, considering the fact that the petitioner has committed very serious and heinous offence as against the victim girl aged about 15 years.
4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
