Heard Mr.C.Prakasam, learned counsel appearing for the petitioner and Mr.S.Gunasekaran, learned Government Advocate, who accepts notice for the respondent. With the consent of either side the Writ Petition itself is taken up for final disposal at the admission stage.
2. The Petitioners are trading in the platforms in Cuddalore Municipal area. The petitioners now seek to quash the tender notification issued by the respondent calling for the tenders from persons, who could collect toll from platform vendors. The
petitioners are under the apprehension that if the tenderer is appointed, there will be lot of other problems to be faced by them and the tenderer would arbitrarily interfere with their business activities.
3. The plea raised by the petitioners is thoroughly misconceived. The Municipality for the purpose of the welfare of public is involved in the process of collecting toll. In fact the procedure adopted by the respondent-Municipality, i.e., calling for the tender is in consonance of Tender Transparency Act. Therefore, there is no error in the procedure adopted by the Corporation and hence the Writ Petition fails and the same is dismissed. Consequently connected miscellaneous petitions are closed.
