The petitioner, who was arrested and remanded to judicial custody on 03.06.2022 for the offences punishable under Sections 363 & 366 of IPC and 5(l) r/w 6 of POCSO Act in Crime No.359 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that under the pretext of love affair, the petitioner kidnapped the victim girl aged about 15 years and committed penetrative sexual assault on her. Hence, the complaint.

3. The petitioner is aged about 20 years. The victim girl is aged about 15 years. On perusal of the statement recorded under Section 164 of Cr.P.C. from the victim girl revealed that though the victim girl fell in love with the petitioner, she was compelled and kidnapped by the petitioner. On the pretext of marriage, the petitioner had committed penetrative sexual assault on the minor victim girl aged about 15 years. Thereafter, she was secured and handed over to her parents.

4. Therefore, the petitioner had committed a very serious and heinous offence as against the minor victim girl. Hence, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition is dismissed.
