ORDER
The petitioner, who was arrested and remanded to judicial custody on 26.03.2026 for the offences punishable under Sections 66E, 67B of IT Act, 11(4), 12, 5(1) r/w 6(1) of POCSO Act, 332(a), 351(3), 77 of BNSS, in Crime No.13 of 2026, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the victim is a school going girl aged about 17 years and she resides with her aunt. The petitioner, who is a married man and having two children followed the victim and on the premise of love, entered into her aunt's house and committed a penetrative sexual assault and also took a video and threatened her that if the same is revealed to anyone, the video will be sent to social media and he will kill the complainant. Hence, the complaint.
3. The learned Government Advocate (Crl.Side) would vehemently oppose for the grant of bail reiterating the prosecution case. Since the victim is a minor girl, the offence is made out under POCSO Act.
4. Considering the grave offence made out by the petitioner, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original petition is dismissed 06.05.2026 dna/av
