Respondents Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus, directing the 2nd and 4th respondents to permit the petitioner for the ensuing University Examination for B.Ed., Degree course to be held in May 2015 and to furnish hall ticket to her, declare the result and to issue mark sheet.

ORDER

Heard M/s.N.Revathi, learned counsel for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader appearing on behalf of respondents 1 to 3.

2. The petitioner seeks for a direction upon the respondents 2 and 4 to permit her to appear for the B.Ed., Degree course to be held in May 2015.

It appears that the petitioner had appeared for +2 examinations during March 2010 and in the Zoology subject, she had obtained totally 70 marks, viz., 20 marks in the theory paper and 50 marks in the Practical paper. According to the respondents, the minimum pass mark in theory paper is 30 out of 150. Hence it was stated that the petitioner has not cleared her +2 examinations.

According to the petitioner, the Headmaster of the School only had issued the Transfer Certificate stating that the petitioner has passed the +2 examinations and based on that she also obtained admission to the degree course and completed the same. Thereafter, she joined the B.Ed., Course in the same college. It is the contention of the petitioner that when she was about to sit for the B.Ed., Examination, it was stated that she has not passed the +2 Examination and accordingly, she cannot write the B.Ed., examination. She would further state that, she appeared as a private candidate during March 2014 and has cleared the Zoology paper. Accordingly, she would now pray for a direction to respondents 2 and 4 to permit her to write the B.Ed., Examination to be held during May 2015 and also for issuance of the hall ticket.

In the light of the above said facts, without going into the merits of the contention raised by the petitioner, there will be a direction to the fourth respondent to consider the petitioner's representation dated 02.01.2015 on merits and in accordance with law and after obtaining appropriate remarks from the second respondentCollege. The petitioner is also directed to submit a copy of the said representation along with a copy of this order to the second respondent as well as the fourth respondent. On receipt of such representation, the respondents shall comply with the direction issued by this Court within a period of three weeks, thereafter.

6. Accordingly, this writ petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. Sd/- Assistant Registrar //True Copy// Sub Assistant Registrar vj2 To 1.
