The petitioner, who apprehends arrest for the alleged offences under Sections 8(c), 20(b)(ii)(B) of NDPS Act and 25(1A) of Arms Act, in Crime No.349 of 2024, on the file of the respondent police, seeks anticipatory bail. 1/4

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 2.143 kilograms of Ganja. The respondent, after following the mandatory provisions, seized the entire contraband, one illegal weapon, a black bag and 65 plastic packets. Hence the complaint.

3. The learned counsel appearing for the petitioners submitted that the petitioner has been implicated in this case, only based on the confession statement of the co-accused and there is no recovery from the petitioner. He further submitted and the co-accused/A1, A2, A3 and A6 were all released on bail. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) would submit that the petitioner is involved in two previous cases which are of similar nature. Hence, he strongly opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the bad antecedents of the petitioners, the custodial interrogation of the petitioners is very much required in this case. Hence, this Court is not inclined 2/4

to anticipatory bail to the petitioners.
