IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 03.11.2017
CORAM:
THE HON'BLE MR. JUSTICE T.RAJA W.P.No.6074 of 2015 in MP.Nos.1 to 3 of 2015 S.Kalaimani .. Petitioner Vs 1.The Member Secretary, Teachers Recruitment Board, College Road, Chennai - 6.
2.K.Rekha .. Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorarified mandamus to call for the records of the first respondent in the provisional selection list of candidates selected as Post Graduate Assistant in Tamil Subject issued by the first respondent dated 25.02.2015 and quash the same insofar as it relates to the selection of the second respondent and consequently direct the first respondent to appoint the petitioner as Post Graduate Assistant in Tamil Subject. For petitioner :Mr.K. Ramasamy For Respondent-1:Mr.K. Venkataramani, A.A.G.
:Asst. by Mr.V. Jayaprakash Narayanan Special Government R2 : NA
O R D E R
Challenging the selection of the second respondent/K.Rekha provisionally to the post of Post Graduate Assistant, the petitioner has filed this writ petition.
2. Heard the learned counsel appearing on either side.
3. The petitioner, having obtained B.A. Degree in 2007 and also B.Ed. degree in 2008, had applied for the post of Post Graduate Assistant pursuant to the Notification dated 07.11.2014 issued by the Teachers Recruitment Board. As per the Notification, if a candidate registered his/her name before three years from the date of Notification in the employment exchange, then he/she would be eligible to get two marks. The said Notification further made it clear that vacancies for the https://hcservices.ecourts.gov.in/hcservices/
said posts shall be filled up on the basis of marks secured in the written examination and also taking note of the waiting period in the employment exchange.
4. In the written examination, the petitioner has secured 94 marks and thereafter, she was also called for Certificate Verification on 16.02.2015. However, she was awarded with only 1 mark for her waiting period in the employment exchange, for, as per the Notification, 1 mark has to be awarded to a candidate who has weightage period of 1 to 3 years, likewise, 2 marks have to be awarded to a candidate, who has weightage period of 3 to 5 years in the Professional and Executive Employment Office, Chennai.
5. Since the petitioner, after completing her M.A. (Tamil) degree, has registered her B.Ed. Degree only on 16.03.2012 before the employment exchange, the respondent has arrived the total weightage period at 2 years 8 months and 10 days towards employment registration seniority, which is less than 3 years from the date of cut-off date fixed by the Teachers Recruitment Board i.e, 26.11.2014. Therefore, as per the Notification, she was rightly awarded with only 1 mark.
6. Thus, in view of the above, awarding of one mark towards employment registration seniority by the respondent cannot be found fault with. Besides, if this one mark is added, the petitioner, who belongs to SC category, would get only 95 marks, which is one mark less than the cut-off marks of 96 fixed for SC category. Thus, on this score, I do not find merit any merit in the writ petition and accordingly, it is dismissed. No Costs. Consequently, connected miscellaneous petitions are closed.
