ORDER
The petitioner, who was arrested and remanded to judicial custody on 29.12.2025 for the alleged offences under Section 8(c) read with 22(c) and 29(1) of NDPS Act, 1985 in Cr. No.329 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that on secret information, while the respondent police conducted vehicle checkup at Kottampalayam, Tiruvannamalai on 29.12.2025 at about 11.10 a.m., found the accused came in a car bearing Registration No.TN49-AY-6426 in a suspicious manner. The respondent police secured the accused and seized 54 grams of Methamphetamine from the pocket of A1, who was the driver of the said vehicle and the petitioner herein and hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is A1 and he has been remanded to judicial custody on 29.12.2025. The learned counsel would further submit that the petitioner has been falsely implicated in this case, only based on his travel, along with other accused, in a car bearing Registration No.TN49-AY-6426 and hence prayed to enlarge the petitioner on bail.

The contention of the learned counsel for the petitioner, was totally objected by the learned Government Advocate (Criminal side) appearing for the respondent police and he would submit that the vehicle bearing Registration No.TN49-AY-6426 was intercepted by the respondent police, where the petitioner / A1 along with other two accused had travelled and all the three were arrested and a commercial quantity of 54 grams of Methamphetamine was recovered from A1. It is the further contention of the learned Government
Advocate that one more accused of Nigerian origin, is still absconding and the petitioner has two previous cases and one among which, is of similar nature. Therefore, he strongly objected the bail application.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.

From the submissions made by the learned Government Advocate, this Court could able to see that 54 grams of Methamphetamine, being a commercial quantity, was recovered from A1 and therefore, the rigors under Section 37 of NDPS Act would attract and apart from that, one of the co-accused is still absconding. As rightly contented by the learned Government Advocate, if the petitioner is enlarged on bail, the same would jeopardise the prosecution case. It is also relevant to mention that the petitioner has two previous cases and among which, one case is of similar nature of the present case. Therefore, this Court is not inclined to enlarge the petitioner on bail.
7. Accordingly, this Criminal Original Petition is dismissed. 02-06-2026 MJS
