ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 319, 336, 338, 240, 318, 3 (5) BNS Act, 2023, in Crime No.3 of 2025, seeks anticipatory bail.

2.The case of the prosecution is that the defacto-complainant has purchased a land in

S.Nos.212/3 and 212/3B to an extent of 0.21 and 0.18 cents respectively at Eluppapattu Village from one Pradeep under a registered sale deed dated 11.02.2006. The defactocomplainant used to go to her daughter's home in America. At that time, the petitioner had created fake Aadhar Card and impersonated the defacto-complainant and sold the said property to one Govindaranan. Hence the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he had been falsely implicated in this case. He further submitted that the custodial interrogation of the petitioner is not required and sought for anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioner. 5.

Head the learned counsels on either side and perused the records. 6.Considering the nature of offence and since, the petitioner had committed very serious and heinous offence as against the defacto-complainant, the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant bail to the petitioner.

7.Accordingly, this Criminal Original Petition is dismissed. 23-06-2025 ep To The Inspector of Police, DCB Police Station.
