Writ petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to pass orders on the representation dated 17.12.2014 seeking revision of property tax within a stipulated time. The petitioner has come forward with the aforesaid prayer.
2. The petitioner has not question the demand notice. However, he submitted that the owners of neighbouring property are paying less than the amount demanded for which he has produced the xerox copy of those demand notices. The petitioner has also made a representation to consider the request vide letter dated 17.12.2014 seeking revision of property tax.
3. This Court directed the second respondent to consider the representation of the petitioner dated 17.12.2014 after affording an opportunity to the petitioner and pass orders in accordance with law and on verifying the tax receipts of similar properties situated adjacent to the petitioner's property.
4. In the mean time, the petitioner is directed to deposit a sum of Rs.2,000/- (Rupees Two Thousand Only) on the demanded amount and https://hcservices.ecourts.gov.in/hcservices/
depending upon the outcome of the order that is going to be passed on representation, the amount may be either refunded or may be adjusted.
5. The second respondent shall give notice to the petitioner, to go and inspect the premises and thereafter, pass appropriate orders on merits and in accordance with law. The second respondent may fix a specific date for inspection which may be intimated to the petitioner. If any demand is made, the petitioner is directed to comply with the same.
With the above observation, this writ petition is disposed of. No costs.
