ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences under Section 303(2) of Bharatiya Nyaya Sanhita, 2023, in Crime No.Not known of 2025, on the file of the respondent police, seek anticipatory bail.

2. The contention of the petitioner is that the Villagers of Maruthavanam had given a false complaint against the petitioner as though the petitioner had committed theft of 10 cows in the year 2024 and the petitioners have now been called for enquiry.

3. It is the further contention of the petitioners that the petitioners are no way connected to missing of the cows in the Village and they are daily wages. For some reasons, the petitioners have been falsely implicated in this case.

4. The learned Government Advocate (Crl.Side) submitted that it is only a petition enquiry in C.S.R. and the same is pending. Hence, the petitioners can appear and given their explanations and thereafter, an appropriate action will be taken.

5. In view of the same, the respondent shall conduct and conclude the enquiry within a period of two weeks from the date of receipt of a copy of this order. If the petitioners' appearance is required, the respondent shall issue a notice under Section 35 of BNSS, 2023, and on such time, the petitioners shall appear before the respondent. Till the conclusion of the enquiry, the respondents shall not arrest the petitioners.

6. With the above directions, this Criminal Original Petition is disposed of.
