The petitioner/A2, who was arrested and remanded to judicial custody on 06.05.2024, pursuant to the Non-Bailable Warrant of arrest issued against him on 24.03.2024 in S.C.No.14 of 2021 pending on the file of the District and Sessions Court, Mayiladuthurai, in connection with Crime No.694 of 2020 registered for the offences under Sections 341, 324, 302, 147, 148, 294(b), 307 & 427 of IPC, seeks bail.
2. Learned counsel for the petitioner submitted that the petitioner is an accused facing trial in S.C.No.14 of 2021 on the file of the District and Sessions Court, Mayiladuthurai. He further submitted that due to the health ailments, the petitioner was unable to appear before the trial Court and thereby a non-bailable warrant of arrest was issued against him by the trial Court and he is in custody from 06.05.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and therefore, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted raised objection stating that since the petitioner, who is arrayed as A2 in this case, failed to appear before the trial Court, a non-bailable warrant was issued against him and pursuant to which, he was arrested on 06.05.2024. He further submitted that the case in S.C.No.14 of 2021 is at the stage of framing of charges and NBW is pending against some of the other accused, therefore, if he is released on bail, there is a possibility of him absconding again and will not available for trial proceedings. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and circumstances of the case, the submissions made by the learned Government Advocate (Crl.Side) that the nonbailable warrant is pending against some of the other accused and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
