ORDER
The petitioner, who was arrested and remanded to judicial custody on 23.02.2026, for the offences punishable under Sections 64(2)(f), 64(2)(l), 64(2) (m) of BNS, in Crime No.3 of 2026, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner is none otherthan the mother of the victim. The petitioner has given sleeping tablets to the defacto
complainant and when she was unconscious, A1 raped her and continuously sexually abused her for several time. Hence, the complaint.
3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent and she has been falsely implicated in this case. He would further submit that the petitioner was arrested and is in judicial custody from 23.02.2026. Hence, seeks for bail.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that petitioner gave tablet to the victim girl and the co-accused committed rape on her. The victim girl has given statement under Section 164 of CrPC. Absconding accused is yet to be arrested. Hence, vehemently opposed the bail.
5. Heard both sides and perused the materials available on record.
6. Considering the facts and circumstances, nature and gravity of offences, the manner in which the offence alleged to have taken place, this Court is not inclined to grant bail to the petitioner. Accordingly, this petition stands dismissed.
