ORDER
Challenging the impugned order passed in E.P.No.1 of 2024 in RLTOP No.1 of 2021 by the learned District Munsif, Ponneri, the Revision Petitioner/Judgment Debtor had preferred this Civil Revision Petition.
2. Pending appeal proceedings, delivery order was passed by the Executing Court. Aggrieved over that, this Civil Revision Petition has been preferred.
3. As on date, the order passed in E.P.No.1 of 2024 was under challenge by the Revision Petitioner in RLTA No.19 of 2023 and the same is pending before the IV Additional District and Sessions Court, Ponneri. In the appeal proceedings, he is having valid defence. If the order is executed, he will be put into much hardship. Furthermore, pending appeal proceedings, the final decree was passed by the trial court. Considering that, this Court is inclined to direct the appellate court/IV Additional District and Sessions Court, Ponneri to dispose the appeal filed in RLTA No. 19 of 2023 within a period of eight weeks from the date of receipt of copy of this order. Till then, the E.P. proceedings initiated in E.P.No.1 of 2024 not to be proceeded by the Executing Court. Accordingly, this Civil Revision Petition is disposed of. No costs.
