Criminal Original Petition filed under Section 482 of Cr.P.C. to direct the learned Principal Sessions and District (Special Judge), SC/ST Act cases, Dharmapuri to consider the petitioner's bail application in Crime No.45 of 2020 pending on the file of the respondent police on the same day on her surrender.

ORDER

This Criminal Original Petition has been laid by the petitioner seeking direction to the learned Principal Sessions and District (Special Judge), SC/ST Act cases, Dharmapuri, to accept the surrender of the petitioner herein in Crime No.45 of 2020, on the file of the learned Principal Sessions and District (Special Judge), SC/ST Act cases, Dharmapuri and consider the bail petition on the same day itself.

2. According to the petitioner, she was arrayed as accused in crime No.45 of 2020, for the alleged offences under Sections 294(b) 506(i), r/w Sec.3(1)(v), 3(1)(x), 3(1)(xiii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 1989. According to the petitioner, she has not committed the offences put forth against her and on account of the false case alleged against her, the petitioner is necessitated to seek for necessary directions. https://hcservices.ecourts.gov.in/hcservices/

3. Considering the facts and circumstances of the case and in the interest of justice, I deem it fit to issue the following directions.

(i) The petitioner shall surrender before the learned Principal Sessions and District (Special Judge), SC/ST Act cases, Dharmapuri, within 10 days from the date of receipt of copy of this order.

(ii) On the petitioner surrendering before the learned Principal Sessions and District (Special Judge), SC/ST Act cases, Dharmapuri, and filing the bail application, the learned Principal Sessions and District (Special Judge), SC/ST Act cases, Dharmapuri, is directed to consider and dispose of the bail application as expeditiously as possible, preferably on the date of surrender in accordance with law.

4. Accordingly, the Criminal Original Petition is disposed of.
