This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 31.05.2024, seeking bail in Crime No.268 of 2024 for the alleged offence punishable under Section 174 Cr.P.C and subsequently it was alter under Section 306 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offence. He further submitted that the petitioner and his wife/victim, are working in the same police station, due to work pressure, his wife committed suicide, based on which, a false complaint has been foisted against the petitioner. He also submitted that the petitioner is in custody from 31.05.2024, and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for bail.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the deceased is the wife of the petitioner and they both work as constables at N.1, Royapuram Police Station, and from the date of marriage, the petitioner under the influence of alcohol https://www.mhc.tn.gov.in/judis

drl tortured his wife by abusing her and assaulting her, which abetted her to commit suicide. Initially, the case was registered under Section 174 Cr.P.C and subsequently, the case was altered into Section 306 of IPC. He further submitted that the investigation in this case is still pending, hence, he opposed for allowing the petition.

Taking into consideration the submissions made by the learned Government Advocate (Criminal Side) that the investigation is still pending and also considering that a valuable life has been lost and also considering the serious nature of the offence, this Court is not inclined to grant bail to the petitioner.
