PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 praying to punish the respondent herein for willful disobedience of the order passed by this Court in Crl.O.P.No.1994 of 2019 dated 11.02.2019.

O R D E R

This contempt petition has been filed as against the respondent for non compliance of the order dated 11.02.2019 passed by this Court in Crl.O.P.No.1994 of 2019, thereby directed the respondent to furnish a copy of Forensic Science Department Report regarding the signature and thumb impression comparison of one late Palani in respect of crime No.6 of 2014.

The learned counsel appearing for the petitioner would submit that this Court directed the respondent to furnish a copy of Forensic Science Department Report within a period of two weeks from the date of receipt of that order. Even after completion of four months, the respondent did not furnish the copy of the report as directed by this Court.

The learned Additional Public Prosecutor appearing for the respondent filed counter and submitted that initially the FIR in Crime No.6 of 2014, registered by the District Crime Branch, Tiruppur and thereafter for further investigation, it was transfered to City Crime Branch, Tiruppur and renumbered as Crime No.9 of 2015. Thereafter, it was found that the entire case has been filed as Mistake of Fact and closed the same. She further submitted that, as directed by this Court, when the respondent tried to serve the copy of the report, the defacto complainant/petitioner refused to receive the same. 4.

Now the copy of the Forensic Science Department Report dated 20.08.2015, regarding the signature and thumb impression comparison of one late Palani, is handed over to the learned counsel appearing for the petitioner and he has also made an endorsement to that effect.

Recording the same, this contempt petition is closed. No costs.
