This petition has been filed to modify the condition imposed on the petitioner by an order dated 14.06.2023 in Crl.O.P.No.12691 of 2023 should make a non refundable deposit of Rs.25,000/- (Rupees Twenty Five Thousand Only) by way of RTGS/NEFT to the credit of "Police Boys Club (T-15 Kannagi Nagar Police Boys and Girls Club.

The learned counsel for the petitioner would submit that the petitioner was arrested and remanded to judicial custody on 01.05.2023 and he was granted bail by this Court for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B), 22(b) and 29(1) of NDPS Act in Cr.No.160 of 2023. He was granted bail on 14.06.2023 and this Court while granting bail had imposed condition that he should deposit Rs.25,000/- to the credit of "Police Boys Club (T-15 Kannagi Nagar Police Boys and Girls Club)". He would further submit that the petitioner hails from poor background, he is unable to raise funds and thereby, he is unable to deposit the amount and come out on bail. He would further submit that despite the order being granted on 14.06.2023, the petitioner is languishing in prison. He would also submit that the petitioner will be able to deposit Rs.5000/- and thereby, the present petition seeking modification has been filed. 1/3

4.Considering the submission made by the learned counsel appearing for the petitioner, the condition imposed as against the petitioner is modified to the effect that " the petitioner is directed to make a non refundable deposit of Rs.5,000/- (Rupees Five Thousand Only) by way of RTGS/NEFT to the credit of "Police Boys Club (T-15 Kannagi Nagar Police Boys and Girls Club), Bank:State Bank of India, A/c. No.32033586872 IFSC Code:SBIB0011932, Branch:Okkiyam Thuraippakkam, Chennai-97, Mobile No.8056156311" without prejudice to his rights and contentions before the trial Court ...". The other conditions shall remain unaltered.

5.With the above directions, this Criminal Miscellaneous Petition is ordered.
