This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 24.04.2024, seeking bail in Crime No.200 of 2024 for the alleged offence punishable under Sections 341, 294(b), 147, 148, 506(ii) IPC and 302 IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offence. He also submitted that the petitioner is in custody from 24.04.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for bail.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the defacto complainant is the uncle of the deceased. On the date of the incident, the petitioner and other accused, along with the deceased traveled on one bike, at that time, the defacto complainant asked them about where they were going, this petitioner told that they were taking him to meet Prabakar, and after sometime, the defacto complainant received an information that the deceased was assaulted due to https://www.mhc.tn.gov.in/judis

drl previous enmity related to ganja property, thereby, he died. He further submitted that five accused were already detained under Act-14 and a goondas proposal is pending for this petitioner. He further submitted that the investigation in this case is still pending, hence, he opposed for allowing the petition.

4. Taking into consideration the submissions made by the learned Government Advocate (Criminal Side) that the investigation is still pending and also considering that there is proposal for detaining him under Act 14 of 1982 is pending, this Court is not inclined to grant bail to the petitioner.
