(The Order of the Court was made by The Hon'ble The Chief Justice) In respect of the subject matter of the issue raised, a FIR is already stated to have been registered against the erring officials https://hcservices.ecourts.gov.in/hcservices/
for the offences under Sections 409, 420 and 477-A of IPC, based on the complaint of the District Collector, Villupuram.
2. The petitioner through this Public Interest Litigation, seeks to array the Contractor also as the prospective accused.
3. On our query, we are informed by the learned counsel for the petitioner that the matter is still under investigation and the finial report has not been filed.
4. We are of the view that the PIL would not be maintainable in a subject like this, apart from the fact that it would amount to interference with the investigation process. If the petitioner is any material germane to the subject matter of investigation, it is however, open to him to give this material to the Investigating Officer and on the final report being filed, if there are grievances, he can proceed in accordance with law.
5. The writ petition stands dismissed with the aforesaid observation. No costs.
