ORDER

The petitioners, who apprehend arrest at the hands of the respondent Police for the offences punishable under Section 318(4) of BNS in Crime No.Not Known of 2026 on the file of the respondent police, seek anticipatory bail.

Today, when the matter is taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petition enquiry in Current Paper No.89 of 2026 is pending against the petitioners.

Having heard the learned counsel appearing on both sides and upon perusal of the materials available on record and considering the facts and circumstances of the case, this Court directs the respondent police to issue appropriate notice to the petitioners under Section 35(3) of BNSS for enquiry. On receipt of such notice, the petitioners shall appear for enquiry and co-operate in the investigation.

It is made clear that the investigating officer must conduct the enquiry by strictly following the procedures therein and if any cognizable offence is made out, the investigating officer shall register a First Information Report or close the petition enquiry within a period of two weeks from the date of receipt of a copy of this order.

The parties are directed to cooperate with the enquiry. It is needless to say that the respondent police shall not take any coercive steps to secure the accused till the completion of enquiry, on the complaint lodged by the de facto complainant.

With the above directions, this Criminal Original Petition is disposed of.
