The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323, 324 and 506(ii) of IPC, in Crime No.2 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that, due to previous enmity, petitioner along with other accused attacked the defacto complainant with hands and also abused in filthy language. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He would further submit that, due to previous enmity, a false case has been lodged by the defacto complainant. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that the injured victim has been discharged from the hospital. He further submitted that there are six previous cases similar in nature pending against the petitioner. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the bad antecedents of the petitioner ie., having six previous cases pending against him, this Court is of the view that the custodial of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 21.07.2022 Sma
