The petitioner, who was arrested and remanded to judicial custody on 03.12.2024 seeks bail in S.C.No.18 of 2013 for the offence punishable under Sections 341, 336, 353, 392 read with Section 397 and 506(ii) of IPC in connection with Crime No.723 of 2010, registered on the file of the respondent. 1/4

2. Learned counsel for the petitioner submitted that the petitioner is an accused facing trial in S.C.No.18 of 2013 on the file of theIV Additional District and Sessions Judge, Chennai. He further submitted that since the petitioner was ill, he was unable to appear before the trial Court, and he was issued with the nonbailable warrant on 18.11.2014 and pursuant to the same, he was arrested on 03.12.2024. He further submitted that the petitioner is a sole breadwinner of his family and due to his incarceration, his family is suffering. He further submitted that the petitioner undertakes to co-operate with the trial. Therefore, he prays for grant of bail to the petitioner.

3. Learned Government Advocate (Crl.Side) appearing for the respondent submitted that the case is pending from the year 2010. He further submitted that, due to the non-appearance of the petitioner, NBW was issued against the petitioner on 18.11.2014 and with great difficulty, the respondent police has arrested the petitioner on 03.12.2024 and it this stage, if the petitioner is released on bail, there is a possibility that the petitioner will abscond and the trial will the stalled. Hence, he oppose for grant of bail to the petitioner. 2/4

4. Considering the facts and circumstances of the case and the case is pending from the year 2010, this Court is not inclined to grant bail to the petitioner at this stage.
