The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 324 & 506(ii) of IPC, in Crime No.317 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that, due to previous enmity, the petitioner attacked the defacto complainant with iron rod, due to which, the defacto complainant sustained grievous injuries. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He would further submit that, due to previous enmity, a false case has been lodged by the defacto complainant. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that due to the alleged occurrence, the defacto complainant sustained fracture injuries and has been admitted in the hospital and taking treatment as in-patient.

5. Considering the gravity of the offence committed by the petitioner and also considering that the injured still in hospital and taking treatment as in-patinet, this Court is of the view that the custodial of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 21.07.2022 Sma
