PRAYER: This Second Appeal has been filed under Section 100 of the Code of Civil Procedure against the judgment and decree dated 14.12.2012 passed in A.S.No.56 of 2011 on the file of I Additional Sub Court, Cuddalore, reversing the judgment and decree dated 28.02.2011 passed in O.S.No.408 of 2006 before the Additional District Munsif Court, Cuddalore.

JUDGMENT
This Second Appeal has been filed against the judgment and decree dated 14.02.2012 passed by the learned Additional Sub Judge, Additional Sub Court No.I, Cuddalore in A.No.56 of 2011.
2. As per the order of this Court dated 04.12.2025, the matter was referred to Mediation Centre, Cuddalore, for settlement between the parties. The District Co-ordinator/Principal District Judge, District Mediation Centre, Cuddalore, vide letter dated 06.01.2026, sought extension of time for mediation, stating that both the parties appeared before the Mediator on 24.12.2025 and there was a likelihood of settlement.
3. When the matter was taken up on 02.02.2026, the learned counsel appearing on both sides would submit that settlement talks were in progress.
4. However, when the matter was taken up for hearing on 18.02.2026, learned counsel appearing on both sides would submit that the parties have settled the matter out of Court and sought time to report no instructions. Hence, the matter was adjourned and the names of the parties were directed to be printed in the cause list.
5. Today, the names of the parties were printed in the cause list.
6. Mrs.Meenal, the learned counsel appearing for the appellants would submit that there were no instructions from the appellants.
7. Recording the said submission, this Second Appeal is dismissed for non prosecution. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
