J U D G M E N T
When the matter is taken up for hearing, the learned counsel appearing for the 1st respondent submitted that he has filed vakalat for 2nd respondent in SR.No.21702 of 2026. The vakalat filed by the learned counsel is put up in the main bundle.
2. Both the counsel appearing for the appellant as well as the learned counsel appearing for the respondents 1 and 2 submit that the dispute has been compromised between the appellant and respondents 1 and 2 and they filed a compromise memo dated 09.06.2026.
3. It is also stated that the respondents 3 to 6 are not parties to the compromise, the second appeal may be dismissed against the respondents 3 to 6.
4. A perusal of the compromise memo would indicate that the suit property has been described as 'B' schedule in the compromise memo. The respondents 1 and 2 agreed that the appellant is entitled to 'A' scheduled property. On her part, the appellant agreed that the respondents 1 and 2 are entitled to 'B' schedule, which is the suit property. 2/4
5. A perusal of the compromise memo would indicate both the appellant and respondents 1 and 2 signed in the compromise memo and they were identified by their respective counsel. The learned counsel for the appellant and respondents 1 and 2 have also counter signed in the compromise memo.
6. In view the same, the said compromise memo is recorded and accordingly, the second appeal is disposed of in terms of compromise memo filed by the appellant and respondents 1 and 2. The compromise memo shall form part of the decree passed in this second appeal. As per the terms of compromise memo, the second appeal stands dismissed as against the respondents 3 to 6. No costs.
