2015-03-09Honourable The Chief Justice,Honourable Mr Justice M.M.Sundresh1 pages

WP No.6401 of 2015 The Hon`ble The CHIEF JUSTICE and The Hon`ble Mr Justice T. S. SIVAGNANAM K.Mahalingam S/o.Kesavan, 1/78, Pillaiyar Koil Street, Melakuppam, Walaja Taluk, Vellore District Vs The District Collector Vellore District, Vellore and 4 others.

We have perused the compliance report filed by the first respondent and take his assurance on record that he will take necessary disciplinary steps. 2.Learned counsel for the 4th and 5th respondents, in the meantime, has pointed out that a notice has been issued by the third respondent dated 09.06.2015 in respect of the land in question asking for trees to be removed. Such a notice would be in violation of our order dated 27.04.2015, where we had clearly mentioned that we are not interested in getting the trees removed, but ensuring that the trees are entered into Government records and proper terms are issued for the entitlement of the usufructs. It appears that the third respondent has not even cared to understand the order passed by this Court. 3.We, thus, call upon the first respondent to even look into this aspect to ensure that no trees are cut and the order passed by us be explained to the third respondent in the language in which he understands it. 4.No further orders are necessary.
