ORDER
The petitioner apprehends arrest for the alleged offence under Section 303(2) of BNS Act, 2023, in Crime No.328 of 2025 on the file of the respondent police seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with other accused has stolen the two wheeler bearing Reg.No.TN 87-E-5924, Bajaj Pulsar 150 blue colour, parked in front of the house of the defacto complainant.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner has been implicated in this case based on the confession of coaccused.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and objected for the grant of anticipatory bail. He added that the petitioner along with other accused has stolen four two wheelers and they have recovered only three two wheelers.
5. Considering the nature of allegations and the grave offence committed by the petitioner and also considering the fact that one more two wheeler has to be recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
