Directing the second respondent to register the sale deed dated 30.12.2024 which was presented for registration vide Temporary No.TP/205447900/2024 dated 30.12.2024, with respect to the property comprised on Site Nos. 322 and 323, Old Survey Nos.293/1F and 293/1G, totally to an extent of 2400 Sq.ft. Situtated at Azhagu Nagar, Pillaiyappapalayam, Village, Annur Taluk, Coimbatore District, within the time limit to be fixed by this Court.

ORDER

The petitioner seeks for the following relief: "Directing the second respondent to register the sale deed dated 30.12.2024 which was presented for registration vide Temporary No.TP/205447900/2024 dated 30.12.2024, with respect to the property comprised on Site Nos. 322 and 323, Old Survey Nos.293/1F and 293/1G, totally to an extent of 2400 Sq.ft. Situtated at Azhagu Nagar, Pillaiyappapalayam, Village, Annur Taluk, Coimbatore District, within the time limit to be fixed by this Court."

2. The petitioner had purchased the property on 13.06.2022. Subsequently, he decided to alienate the property in favour of one Mr. G. Nagaraj and presented the document on 30.12.2024. He pleaded that the document was not registered by the respondents, stating that proceedings were pending before the Court of law. Hence, this Writ Petition.

3. When the matter has taken up for hearing, Mr. Karthik Jagannathan, learned Government Advocate appearing for the respondents, on instructions, stated that no such refusal was made. He has also produced a letter of the SubRegistrar, Annur, dated 21.05.2025, and the same is taken on record.

4. I have heard Mr. M. Vijaya Ragavan, learned counsel for the petitioner and Mr. Karthik Jagannathan, learned Government Advocate, learned

Government Advocate appearing for the respondents, and perused the materials available on record, including the letter dated 21.05.2025.

5. The mere pendency of the civil proceedings is not a bar to the registration of a document. This position has been settled by a Division Bench of this Court, in N. Ramayee v. The Sub-Registrar, Registration Department and Ors., reported in 2020 (6) CTC 697.

6. Hence, if the document is otherwise in order, the respondents are directed to register the same. He shall not cite the reason of pending civil proceedings to refuse to register the document.

7. With the above observation and direction, this Writ Petition is disposed of. No costs.
