On perusal of the records, fourth Appellant Periyasamy is the son of the deceased woman. The Appellants in this case are the legal heirs of the deceased woman who died in a road traffic accident. Therefore, after due enquiry, M.C.O.P claim petition was allowed. Against the award, Appeal had been filed seeking enhancement of the award. The claim of the Appellants that the name of the deceased Periyasamy is to be removed cannot be accepted as he is the eldest son of the deceased woman. Until the legal heirs of the deceased Periyasamy are impleaded, the Appeal cannot be numbered.

Learned Counsel for the Appellant is directed to implead the legal heirs of Periyasamy.
