ORDER
The petitioner, who was arrested and remanded to judicial custody on 23.03.2025 for the alleged offences under Sections 232 and 351(3) of the Bharatiya Nyaya Sanhita, 2023, in Crime No.154 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 17.12.2025, at about 9.30 pm, the petitioner, who is a life convict, contacted the de facto complainant via cell
phone and threatened him, stating that he should not give evidence in a murder case pending in the Trichy Court against the third accused. Subsequently, the petitioner's wife (A2) also threatened him, stating that she is A1's wife and that if he gives evidence, he will be murdered by his associates. However, the de facto complainant did not disclose the facts to anyone, on 04.03.2026, he lodged a complaint with the respondent police against the petitioner and two others, 78 days after the alleged threat.

The learned counsel appearing for the petitioner would submit that the petitioner has been in judicial custody since 23.03.2026 and that the petitioner was not involved in the incident as alleged by the prosecution. There is a delay in filing the FIR and criminal cases are also pending against the de facto complainant. The learned counsel would further contend that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the granting of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing the grant of bail to the petitioner, reiterated the prosecution's case and submitted that there are three previous cases pending against the petitioner. He further submitted that if the petitioner is released on bail, he will abscond and tamper with the witnesses.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. Considering the submission made by the learned counsel on either side, nature of offence, previous bad antecedents of the petitioner's, this Court is not inclined to grant bail to the petitioner.
