This application is filed seeking to raise the prohibitory order dated 01.02.2017 made in Application No.4848 of 2016 whereby prohibiting the Garnishee from making payment upto a limit of Rs.1,40,192/- to the respondent by withholding the salary of respondent to the extent as contemplated in Section 60 of C.P.C. Viz. After deducting the first Rs.1000/- of the salary of the respondent and withholding 1/3rd of the remainder salary and deposit the amount of salary so withheld every month to the credit of the above application.

2. It is stated in paragraph 4 of the affidavit filed in support of the application that pursuant to the prohibitory order dated 01.02.2017, the dispute was settled between the parties. The said order was communicated to the garnishee and the garnishee will continue further action in compliance of the order until the same is raised. Hence, the applicant has filed this application to raise the prohibitory order dated 01.02.2017.

3. In view of the above, the prohibitory order passed in A.No.4848 of 2016 is raised and vacated and the application is ordered. Consequently, A.No.4848 of 2016 is also closed. 02.07.2019 rsi http://www.judis.nic.in
