Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of MANDAMUS directing the 1st and 2nd respondents to effect the mutation of revenue records based on the application submitted by the petitioner on 13.08.2014 expeditiously. For Petitioner :

ORDER

Heard Mr.P.Manikannan, learned counsel for the petitioner and Mr.P.V.Selvakumar, learned counsel appearing on behalf of the respondents and with their consent, the writ petition is disposed of at the admission stage itself.

2. The petitioner has filed this writ petition to direct the 2nd respondent to consider his representation dated 13.08.2014 and effect mutation of the revenue records.

The petitioner would state that he and one Balaji are absolute owners of the property in question, which originally belonged to K.Nagarathinam, who had purchased the same from Mrs.Sabitha, W/o.K.C.Narayanasamy, by a registered Sale Deed bearing document No.2238 of 1996 on the file of the Sub Registrar Office, Konnur.

It is stated that Nagarathinam executed a registered Will in favour of the petitioner and Balaji registered as document No.28 of 2010 dated 19.03.2010 on the file of the Sub Registrar Office, Konnur and subsequently, he passed away on 24.11.2005. The petitioner would state that they being the beneficiaries of the property, having acquired the same through the registered Will, which was admittedly executed when the property in question was not within the Chennai Metropolitan area, now seek for mutation of revenue records, both in the name of the petitioner and G.Balaji. In this regard, the petitioner has given a representation dated 13.08.2014 along with enclosures and also remitted a sum of Rs.50/- said to be the charges for effecting the transfer.

In the light of the above, without going into the merits of the petition, there will be a direction to the 2nd respondent to consider the representation of the petitioner, after notice to the petitioner and G.Balaji and pass a reasoned order, on merits in accordance with law, within a period of three months from the date of receipt of a copy of this order.

6. The writ petition is disposed of with the above direction. No costs.
