ORDER

The instant Civil Revision Petition has been filed against the dismissal of application filed by the petitioner/first defendant, seeking to permit her to let in oral evidence after the completion of other defendants evidence in the suit O.S.No.35 of 2004, which is pending on the file of the learned I Additional District Judge, Cuddalore. 2.The learned counsel for the petitioner submits that the petitioner is an aged lady and now more than 89 years old and hence she is not going to depose before the trial Court and therefore, the instant Civil Revision Petition has now become unnecessary. 3.Recording the submissions made by the learned counsel for the petitioner, the Civil Revision Petition is dismissed as infructuous. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
