Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the fifth respondent to issue Joint Patta to the petitioners pertaining to the lands situated in Survey No.11/2, measuring 0.36 cents and in Survey No.11/ 5 measuring 0.32 cents totally measuring an extent of 0.68 cents at No.15, Amthurmedu Village, Poonamallee Taluk, Thiruvallur District.

ORDER

This writ petition has been filed seeking for a direction, directing the fifth respondent to issue Joint Patta to the petitioners pertaining to the lands situated in Survey No.11/2, measuring 0.36 cents and in Survey No.11/ 5 measuring 0.32 cents totally measuring an extent of 0.68 cents at No.15, Amthurmedu Village, Poonamallee Taluk, Thiruvallur District. 2/6

2. It is the case of the writ petitioner that the lands were originally acquired under Urban Land Ceiling Proceedings. This Court in W.P.No.36751 of 2007, by Order dated 06.12.2012 quashed the proceedings which was also confirmed by the Division Bench in W.A.No.488 of 2016 by judgement dated 25.04.2016. Therefore, the petitioner has sent a representation for issuance of patta on 16.04.2024, however, the same is pending till date. Hence, this writ petition.

3. The learned Special Government Pleader also admitted that the acquisition proceedings have been quashed.

4. Heard both sides and perused the materials placed on record. By consent of both parties, this writ petition is taken up for final disposal in the admission stage itself.

5. When the acquisition proceedings is already quashed by the Division Bench and the matter has reached finality, there shall be a direction to the fifth respondent to consider the representation of the petitioner dated 16.04.2024 and pass appropriate orders with regard to issuance of patta on merits and in accordance with law within a period of three months from the date of receipt of 3/6

a copy of this Order.
