ORDER
This petition has been filed seeking relaxation of the condition imposed on the petitioner that the petitioner shall report before the respondent police daily at 10.30 a.m for a period of two weeks and thereafter as and when required for interrogation in Crl.O.P.No.36090 of 2025 dated 21.04.2026.
2. The learned counsel for the petitioner would submit that the petitioner is suffering from Jaundice and he has provided only the medical certificate and when this Court put a pertinent question whether the petitioner is recovered from Jaundice or not, the learned counsel would submit that the petitioner is still taking treatment in the hospital. However, no hospital records has been filed.
3. On the other hand, the learned Government Advocate (Crl. Side) would strongly oppose this application on the ground that the petitioner has complied with the condition only for three days and this is a case of a cheating.
4. Hence, considering the nature of allegation and the absence of any document to substantiate the medical ailment, this Court is not inclined to relax the condition at this stage.
5. Accordingly, this Criminal Miscellaneous Petition is dismissed. However, the petitioner is given liberty to file a proper application, along with the medical records.
