Respondents Civil Revision Petition filed under Article 227 of Constitution of India challenging the order dated 22.07.2014 passed by the learned Subordinate Judge of the Nilgiris at Ootacamund in I.A. No.24 of 2014 in A.S. No.8 of 2014 wherein stay of the operation of the Judgment and decree in O.S. No.86 of 2007 dated 19.03.2014 passed by the learned District Munsif, Ootacamund in favour of the petitioner has been granted.

ORDER

The instant Civil Revision Petition has been filed challenging the order dated 22.07.2014 passed in I.A. No.24 of 2014 in A.S. No. 8 of 2014 by the

Subordinate Judge, Nilgiris, at Ootacamund, granting stay of operation of the judgment and decree dated 19.03.2014 passed in O.S. No.86 of 2007 on the file of the learned District Munsif, Ootacamund.

2. The petitioner is the plaintiff in the suit and the first respondent is one of the defendants in the suit. It is submitted by the learned counsel appearing on both sides that the first appeal viz. A.S. No.8 of 2014 is now ripe for arguments before the learned Subordinate Judge of Nilgiris, Ootacamund. This being the case, this Court is of the considered view that in the ends of justice, if the first appeal viz. A.S. No. 8 of 2014 is disposed of expeditiously, it will enure to the benefit of both the parties in this revision. Therefore, this Court directs the learned Subordinate Judge, Nilgiris, at Ootacamund to dispose of A.S. No.8 of 2014 filed by the first respondent in this revision petition within a period of three months from the date of receipt of a copy of this order.

3. With the aforesaid directions, the Civil Revision Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 07.06.2019 Index: Yes/ No Internet: Yes/No Speaking Order/Non-speaking Order vsi2
